These Terms of Service (“Terms”) govern your access to and use of Pixpad (“we”, “us”, or “our”), including our public image tool pages, the Quick Image Editor, workspace features, and related services (collectively, the “Service”).

By creating an account, signing in, uploading content, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the Service. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

You are responsible for maintaining the confidentiality of your sign-in method and for all activity under your account. Notify us promptly if you suspect unauthorized access.

We may suspend or terminate accounts that violate these Terms, pose security risks, or are used for abusive or unlawful activity.

Pixpad provides online image editing tools. Some features run entirely in your browser; AI-powered features require uploading images to our cloud infrastructure for processing, as described in our Privacy Policy.

We may change, limit, or discontinue features at any time. We do not guarantee uninterrupted availability and may perform maintenance that temporarily affects access.

You retain ownership of images and other content you upload, subject to applicable law. You grant us a limited license to host, process, transmit, and display your content solely to operate the Service (for example, to run an AI job you request and return a result).

You represent that you have the rights and permissions needed to upload and edit your content, including for commercial use of outputs where applicable. You are responsible for ensuring your use does not infringe third-party rights (such as trademarks, copyrights, or likeness rights).

Subject to applicable law and your subscription plan (if any), you may use outputs from the Service for personal or commercial projects unless we state otherwise for a specific feature.

You agree not to:

AI outputs may be imperfect or unsuitable for your intended use. You are responsible for reviewing results before publication or commercial use.

We do not use your uploads to train public or third-party AI models for unrelated purposes, as described in our Privacy Policy.

If you purchase a paid plan, fees, billing cycles, refunds, and cancellations are governed by the pricing information presented at checkout and any additional billing terms we provide. Taxes may apply where required by law.

Failure to pay may result in suspension of paid features. Chargebacks or payment disputes may lead to account review.

The Service may integrate with third-party providers (for example, authentication, payments, analytics, or cloud processing). Your use of those services may be subject to their terms and policies.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PIXPAD AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (USD $100), WHERE PERMITTED BY LAW.

You will defend and indemnify Pixpad against claims, damages, and expenses (including reasonable legal fees) arising from your content, your use of the Service, or your violation of these Terms or applicable law, to the extent permitted by law.

You may stop using the Service at any time. We may suspend or terminate your access if you materially breach these Terms or if required for legal, security, or operational reasons.

Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and indemnity) will survive.

We may update these Terms from time to time. We will post the revised Terms with an updated “Last updated” date. Material changes may be communicated through the Service or by other reasonable means. Continued use after changes become effective constitutes acceptance.

These Terms are governed by the laws applicable where Pixpad operates, without regard to conflict-of-law rules, except where mandatory consumer protections in your country require otherwise.
